The Guide
What to Do After a Florida Car Accident
Five short sections. Read what you need, when you need it.
01
First 60 Minutes
Immediate Actions
- Turn on hazard lights and move out of traffic if the vehicle is safe to drive.
- Call 911 — even for minor accidents. A police report is critical evidence in Florida.
- Do not move anyone seriously injured unless there is fire or ongoing danger.
- Get medical help the same day. Adrenaline hides whiplash, concussions, and internal injuries.
02
Evidence
Document Everything at the Scene
- Photos of all vehicles, damage, license plates, and the surrounding road.
- Photos of skid marks, debris, traffic signs, signals, and weather conditions.
- Photos of your own injuries — and new ones every few days as bruising develops.
- Get the other driver's license, insurance card, and registration. Collect witness names and phone numbers.
03
Avoid
Mistakes That Destroy Florida Claims
- Never say "I'm sorry" or "I'm fine" — both are quoted as admissions.
- Never give a recorded statement to the other driver's insurance company.
- Never accept the first quick settlement offer. Once you sign, you cannot reopen the case.
- Stay off social media. Any photo will be used to argue you weren't really hurt.
04
Compensation
What You Can Claim
- All medical bills — current and future, including rehab and therapy.
- Lost wages and loss of future earning capacity.
- Vehicle repair or full replacement value.
- Pain and suffering, emotional distress, and loss of enjoyment of life.
05
Florida Deadline
You Have 2 Years
- Florida's statute of limitations for car accident injury claims is 2 years from the date of the crash (recent change from 4 years).
- Property damage claims have a longer window — but evidence disappears fast.
- Miss the deadline and you lose your right to compensation permanently.
- The earlier you act, the stronger your case.
